1. Acceptance of Terms

These Terms of Use ("Terms") govern your use of the Rise mobile application ("App") made available on the Apple App Store. By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

These Terms form a legal agreement between you and the individual developer of Rise ("we," "us," or "our"). They are not a contract with Apple, Inc.

2. License to Use the App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use Rise on any Apple device that you own or control, solely for your personal, non-commercial purposes.

You may not:

• Copy, modify, or distribute the App or any part of it
• Reverse engineer, decompile, or disassemble the App
• Use the App for any unlawful purpose or in violation of any applicable law or regulation
• Attempt to extract the source code or create derivative works from the App
• Sell, sublicense, rent, or transfer your rights to use the App

3. In-App Purchases

Rise offers optional in-app purchases, including a Pro upgrade and streak freezes. All purchases are processed by Apple through the App Store and are subject to Apple's Terms of Sale.

All sales are final. We do not offer refunds for in-app purchases. If you believe you are entitled to a refund, you must request it directly from Apple through the App Store. We have no ability to process refunds on Apple's behalf.

Prices are set in your local currency as displayed in the App Store and may vary by region. We reserve the right to change pricing at any time; price changes will not affect purchases already completed.

4. Your Data

All data you create in Rise (including goals, habits, todos, progress logs, and settings) is stored locally on your device. We do not collect, access, or store any of your data on external servers.

You are solely responsible for maintaining backups of your data. We are not liable for any loss of data resulting from device failure, App deletion, iOS updates, or any other cause.

5. Intellectual Property

Rise, including its design, code, graphics, icons, and all other content, is owned by us and protected by copyright, trademark, and other applicable intellectual property laws.

Nothing in these Terms grants you any right to use our name, logo, or other brand elements. All rights not expressly granted are reserved.

6. Availability and Updates

We may update, modify, suspend, or discontinue the App (or any feature within it) at any time without notice or liability. We do not guarantee that the App will always be available, error-free, or compatible with future versions of iOS.

Updates may be delivered through the App Store. Some updates may be required for continued use of certain features. We are not obligated to provide any updates or support.

7. Disclaimer of Warranties

We do not warrant that the App will meet your requirements, that it will be uninterrupted or error-free, or that any defects will be corrected. Your use of the App is at your sole risk.

Rise is a personal productivity tool. It does not provide medical, psychological, or professional advice. Do not rely on it for decisions that affect your health, safety, finances, or legal rights.

8. Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of data, loss of profits, or loss of goodwill) arising from your use of or inability to use the App, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us in the twelve months preceding the claim, or $10 USD if no purchase was made.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability, so some of the above limitations may not apply to you.

9. Third-Party Services

The App uses Apple's App Store infrastructure for distribution and in-app purchases. Your use of the App Store is subject to Apple's Terms and Conditions. We are not responsible for Apple's services or any issues arising from them.

The App does not integrate any other third-party services, SDKs, or external platforms.

10. Apple's Role

Rise is distributed through the Apple App Store. Apple is not a party to these Terms and has no obligation to provide any maintenance or support for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.

Apple is not responsible for addressing any claims you or any third party may have relating to the App or your use of it, including product liability claims, consumer protection claims, intellectual property claims, or any claim under applicable law.

Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in California.

If you are a consumer in a jurisdiction that requires disputes to be resolved under local law, those local law requirements will apply to you.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. If changes are material, we will endeavor to notify users within the App.

Your continued use of the App after any changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the App.

13. Termination

These Terms remain in effect as long as you use the App. We may terminate or suspend your access to the App at any time if you violate these Terms. Upon termination, the license granted to you will immediately cease. Sections that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will do so.

You may terminate these Terms at any time by deleting the App from your device.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of Rise and supersede any prior agreements or understandings.

If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
